1. Organizer and Scope

These Terms of Participation apply to all contracts regarding participation in SCALPVERSE, specifically in the capacity of attendee, competition participant, artist, or speaker.
Supplementary regulations may apply to specific areas, particularly the competition or speaker engagements. Individual agreements and more specific terms of participation take precedence over these general terms.

2. Registration and Conclusion of Contract
The display of tickets and participation options on the website does not constitute a binding offer to enter into a contract.
By completing the order or registration process, the participant submits a binding offer to participate.
The contract is concluded upon receipt of the booking or registration confirmation from SCALPVERSE.
The number of available places may be limited.

3. Participation Fee and Payment
The ticket price or participation fee displayed on the website at the time of booking applies.
Payment is made via the payment methods offered during the order process.
Unless otherwise agreed, the full amount is due upon conclusion of the contract.
In the event of outstanding payment, participation may be refused until full payment has been received.

4. Ticket Transfer
Transferring a ticket to another suitable person may be possible subject to prior coordination with SCALPVERSE.
There is no entitlement to a transfer, particularly if the ticket is subject to specific participation requirements—for example, in the case of competition participants or speakers.

5. Cancellation by Participant
Cancellation must be made in text form (e.g., via email). The time of receipt of the cancellation by SCALPVERSE is decisive.
In the event of cancellation, the following portions of the participation fee already paid will be refunded:

• More than 90 days before the start of the event: 75% refund

• 90 to 60 days before the start of the event: 50% refund

• 59 to 30 days before the start of the event: 25% refund

• Less than 30 days before the start of the event: no refund

No refund will be issued in the event of non-attendance or partial participation.

The participant expressly reserves the right to prove that SCALPVERSE incurred no loss or a significantly lower loss as a result of the cancellation.

To the extent that the vacated spot can be reallocated or cost savings are realized, these will be taken into account appropriately.

Statutory rights of withdrawal or other statutory rights remain unaffected.

6. Cancellation by SCALPVERSE
SCALPVERSE may cancel the event for objectively justified reasons, particularly in the event of:

• insufficient number of participants,

• unavailability of key contributors with no reasonable alternative available,

• force majeure,

• official orders,

• significant security risks,

• circumstances rendering proper execution impossible or unreasonable.

In the event of a complete cancellation, participation fees already paid will be refunded.
Further claims—specifically for reimbursement of independently booked travel, accommodation, or other personal expenses—exist only in accordance with statutory liability provisions.

7. Postponement of the Event
If the event must be postponed to a different date, participants will be informed as early as possible.
Tickets already booked generally remain valid for the rescheduled date.
If a participant cannot attend the rescheduled date, they may withdraw from the contract within the reasonable period specified in the notification. In this case, the participation fee paid will be refunded.

8. Changes to Program, Speakers, and Schedule
SCALPVERSE may make changes to the schedule, individual program items, speakers, demonstrations, venues, or organizational details for objective reasons.
Such changes do not automatically entitle the participant to cancel or claim a reduction in the participation fee, provided the essential character of the event is preserved and the change is reasonable for the participant.

9. Competition and competition rules
The published Competition Rules also apply to participants in the SCALPVERSE Competition.
These may contain, in particular, regulations on: 

• participation requirements, 

• approved machines, needles, pigments and work materials, 

• work surfaces and equipment, 

• hygiene and safety requirements, 

• competition duration, 

• Competition works and categories, 

• evaluation criteria, 

• behavior during the competition, 

• reasons for exclusion, 

• Awards and placements.

By registering for the competition, the participant accepts the competition rules that apply.

10. Jury and evaluation
The competition works will be evaluated by a jury appointed by SCALPVERSE.
The evaluation is carried out based on the criteria defined for the respective category.
These may include in particular:
Technology · Precision · Naturalness · Uniformity · Design · Overall impression · Hygiene · Compliance with regulations
The specific weighting will be announced in the Competition Rules or before the start of the competition.

Jury members must disclose any identifiable personal or economic conflicts of interest to the event management.
In such a case, SCALPVERSE can take appropriate measures, in particular excluding the relevant jury member from evaluating individual competition participants.
Any attempt to unduly influence jury members, manipulate ratings or gain an unfair advantage can lead to exclusion.

The jury's technical evaluation decisions are generally final.
Obvious calculation, allocation or procedural errors can be reported to the event management and checked.
There is no entitlement to a specific rating, placement or award.
If it subsequently turns out that a placement was achieved through deception, manipulation or a significant violation of the rules, SCALPVERSE can correct or revoke the placement.

11. Work Materials and Participant Responsibility
Unless otherwise specified in the respective event description, competition participants must bring their own personal work materials.
Each participant is responsible for the proper, safe, and legally compliant use of their own equipment and materials.
Participants must comply with the house rules as well as all hygiene and safety regulations established by the event venue and event management.

12. Speakers
Supplementary individual agreements may be concluded with speakers.
These may, in particular, govern:

• presentation topic and scope,

• timeframe,

• technical requirements,

• fee,

• travel and accommodation expenses,

• usage rights regarding presentations,

• photo and video recordings,

• publication of name, profile photo, social media profile, biography, and presentation topic.

Individual speaker agreements take precedence over these General Terms and Conditions of Participation.

13. Exclusion from the Event
SCALPVERSE may exclude participants from the event or competition in the event of serious or repeated violations of these Terms of Participation, the Competition Rules, or applicable hygiene, safety, or conduct regulations.
This may apply, in particular, in cases of:

• serious safety or hygiene violations,

• manipulation of the competition,

• intentional provision of false information,

• significant disruption of the event proceedings,

• insults, threats, or harassment directed at other participants, speakers, jury members, or staff,

• repeated disregard for legitimate instructions given by event management.

The financial consequences of an exclusion depend on the circumstances of the individual case and applicable legal provisions.

14. Photo and Video Recordings
SCALPVERSE is a professional event where photo and video recordings form part of the event documentation and external communications.
During the event, recordings will be made of, among other things:

• event venues and atmosphere,

• the competition,

• the stage,

• presentations and demonstrations,

• the jury,

• award ceremonies,

• groups of participants,

• general impressions of the event.

Participants must therefore anticipate being recognizable in such recordings.
The recordings may be used for purposes including:
documentation of SCALPVERSE, reporting, website, social media, press and public relations, and the promotion of future SCALPVERSE events.

Where processing is based on legitimate interests, such legitimate interest lies specifically in the documentation and public presentation of the event.
Additional consent may be obtained for targeted interviews, staged individual portraits, or similar recordings in which a person is specifically captured as the main subject for further promotional purposes.

15. Copyright and Recordings
Lectures, presentations, demonstrations, scripts, videos, graphics, materials, and other event content may be protected by copyright.
Without the consent of the respective rights holder, these may not, in particular, be:

• recorded in full,

• reproduced,

• published,

• distributed, or

• used commercially.

Private photo or video recordings may be permitted, provided that SCALPVERSE and, where applicable, the respective speaker allow this and the rights of third parties are not infringed upon.

16. Data Protection
Personal data is processed to the extent necessary for the booking, payment, organization, and execution of the event, or if another legal basis exists.
Further information—particularly regarding ticket purchases, payment service providers, participant data, and photo and video recordings—can be found in the privacy policy on the website.

17. Liability
SCALPVERSE accepts unlimited liability for damages resulting from injury to life, body, or health, as well as for damages caused by willful intent or gross negligence.
In the event of a breach of essential contractual obligations due to simple negligence, liability is limited to foreseeable damage typical of the contract.
Otherwise, statutory provisions apply.
No responsibility is assumed for the safekeeping of participants' personal belongings unless a specific agreement regarding safekeeping has been expressly made.

18. Right of Withdrawal

Where participants act as entrepreneurs in the exercise of their commercial or self-employed professional activity when booking, no statutory right of withdrawal for consumers applies.

Statutory rights of withdrawal may apply to bookings made by consumers.

Statutory provisions regarding the right of withdrawal remain unaffected. Where a right of withdrawal exists, the separate instruction on the right of withdrawal and the electronic withdrawal option provided on the website apply.

Whether an exception to the right of withdrawal applies to a specific event depends on the specific classification of that event. Although Section 312g of the German Civil Code (BGB) contains an exception for certain scheduled leisure services, professional industry events should not simply be treated as exempt from the right of withdrawal across the board.

19. Travel, Accommodation, and Personal Expenses

Travel, accommodation, and other personal travel expenses are generally not included in the participation fee, unless expressly stated otherwise in the respective ticket description.

Participants are responsible for arranging these services themselves.

20. Final Provisions

German law applies.

Statutory rules regarding the place of jurisdiction apply to consumers.

If the contractual partner is a merchant, a legal entity under public law, or a special fund under public law, the registered office of SHÆDE may be agreed upon as the place of jurisdiction.

Should individual provisions of these Terms of Participation be or become invalid, the validity of the remaining provisions shall remain unaffected. Statutory provisions shall apply in place of the invalid provision.
